Am I Entitled to Compensation After I’m Injured On The Job in New Jersey?

Under Workers’ Compensation Law in New Jersey, once an employee has been deemed unable to work due to their workplace injury for more than seven (7) days by a workers’ compensation doctor, an employee is entitled to be paid temporary total disability benefits which amount to 70 percent of the employee’s average gross weekly wage for the 26 weeks prior to the injury.  This amount is subject to a minimum rate of $246.00 per week and a maximum rate of $921.00 for the year 2019 and is adjusted annually.  These payments will continue until the employee is deemed able to return to work by the workers’ compensation doctor either on restricted duty that can be accommodated by the employer, or full duty if no restricted duty work can be accommodated by the employer.

The workers’ compensation statute requires that an employee who is hurt on the job must report the injury to their employer as soon as possible. Upon notice to your employer of the accident, you are entitled to three benefits. They are:

  1. all of your medical treatment and bills will be covered as long as you go to an authorized doctor
  2. while you are unable to work and healing, you will receive 70% of your wages up to a state maximum
  3. you are entitled to a “Permanency Award” – this applies to a functional loss or disability that is attributed to your on-the-job injury
