Client of Todd J. Leonard Law Firm Receives $1 Million Settlement After Slipping at a Local Restaurant

At the Todd J. Leonard Law Firm, we recently represented a client in Kapidzic v. McCormick & Schmick’s Seafood Restaurant. This case was featured in the New Jersey Law Journal on Nov. 18. In this case, our client was left disabled after a fall at a local restaurant which resulted in a $1 million settlement on Sept. 12 for her Bergen County suit.

Our client, was injured in October 2009, when she stepped on a slippery floor at McCormick & Schmick’s in the Riverside Square Mall located in Hackensack New Jersey. As a result of her fall she suffered lumbar herniations that required surgery. Following this slip and fall accident the Social Security Administration deemed that she was totally disabled, meaning her condition was so severe that she is unable to perform basic work duties.

In this suit against the restaurant, we asserted negligence and premises liability claims, arguing that McCormick & Schmick’s knew about prior falls that happened at the site. In response to our allegations, the restaurant denied liability and attributed our client’s injuries to a prior car accident and a degenerative disk condition.

On August 8, partner Todd Leonard settled the case for $1 million during mediation with retired Superior Court Judge Anthony Sciuto, which was another successful case result for the Todd J.
