New Jersey Truck Accidents Involving XPO Logistics Truck Drivers

According to the most recently available data from the Federal Motor Carrier Safety Administration (FMCSA), there are over 400,000 accidents involving commercial trucks each year. These accidents claim more than 3,800 lives per year.

In particular, New Jersey sees a large number of truck accidents due to the state’s central location along the Eastern Seaboard and the several major highways leading throughout the state. In fact, according to the state’s Department of Transportation, in 2018, there were 31 fatal New Jersey truck accidents, resulting in 34 deaths.

According to the FMCSA, XPO Logistics truck drivers were involved in 657 crashes in the most recent 24-month period. Of these accidents:

• 455 accidents requiring at least one vehicle be towed from the roadway,
• 190 accidents resulting in at least one injury, and
• 12 accidents causing the death of one or more people

The FMCSA keeps track of XPO Logistics’ safety record. Over a two-year period ending in October 2019, the company was cited 637 times for unsafe driving violations. These include speeding, unsafe lane changes, failure to yield and distracted driving. The FMCSA also conducted inspections on over 5,300 XPO truck drivers, with the following findings:

• 48 driver fitness violations
• One drug and alcohol violation
• 90 hours of service compliance violations

The FMCSA also identified 1,255 vehicle maintenance violations, such as failing to safely secure loads, damaged tires, impaired view and missing safety equipment.

What to Do After a New Jersey Semi-Truck Accident Involving an XPO Logistics Truck

If you are seriously injured in a truck accident, you can pursue a claim for compensation against the at-fault truck driver and, in many cases, the trucking company. Those who have been injured in a New Jersey truck accident with an XPO truck driver should take certain steps to ensure that they do not jeopardize their right to obtain a recovery for their injuries.

Anyone involved in a major truck accident should do the following:

1. Report the accident

The moments after an accident are an incredibly stressful time. However, it is crucial that an accident victim remains at the scene and report the accident to the police and their insurance company.

2. Obtain medical treatment

In the wake of a New Jersey truck accident, adrenaline is running high. This can mask the symptoms of what may later turn out to be a serious injury. Accident victims should take up any offer for ambulance transport to ensure they get the medical attention they need.

3. Locate and identify any witnesses

If the cause of an accident is disputed, having an uninterested witness is critical. Other motorists, passengers or nearby pedestrians may have seen the accident. Accident victims should obtain the contact information from these parties so their attorney can follow-up and obtain a statement.

4. Exchange all contact and insurance information with other drivers

After any New Jersey car accident, it is essential to exchange all contact and insurance information with the other parties involved in the accident. While the responding police officers should collect this information, accident victims should not assume that will be the case.

5. Document the accident

If possible, accident victims should take photographs of the accident. This includes getting shots of the vehicles and their location on or off the road. It is especially important to document any damage to the vehicles. However, accident victims should refrain from photographing any other injured people.

6. Be careful when speaking to the insurance company

After a New Jersey truck accident, it may be tempting to talk about the accident with an insurance company. However, insurance companies are looking for reasons to deny or reduce the value of an accident victim’s claim. It is best to consult with an experienced personal injury attorney after reporting your accident with your insurance company.
