New Jersey Truck Accidents Involving Landstar System, Inc. Drivers

Each year, there are more than 400,000 accidents involving large commercial trucks across the United States. In total, these accidents claim more than 3,800 lives. The Federal Motor Carrier Safety Administration (FMCSA) tracks all truck-accident data.

According to the FMCSA data, Landstar System truck drivers were involved in 456 crashes in the most recent 24-month period. Of these accidents:

• 321 accidents resulted in property damage only,
• 122 accidents resulted in at least one injury, and
• 13 accidents resulted in one or more deaths

The FMCSA also maintains detailed safety records related to every trucking company on a rolling 24-month basis. Over the past 24 months, Landstar System, Inc., was cited 1,149 times for unsafe driving violations. The most common violations among Landstar System drivers were:

• Speeding
• Lane restriction violations
• Failure to obey traffic control devices
• Following too closely
• Failure to maintain a single lane of travel
• Using a cell phone while driving
• Improper lane change
• Inattentive driving
• Failure to yield the right of way
• Driving under the influence of drugs or alcohol

Landstar drivers were also cited 492 times for “hour of service violations.” Federal law requires truck drivers only to drive for a certain number of hours per day, and take breaks between long trips. Truck drivers must log their driving and rest time in a driving log. In the most recent 24-month period, Landstar System drivers were cited for filing a false report 96 times.

Landstar also incurred a significant number of equipment violations. Over the last 24 months, the company was cited nearly 4,200 times for various equipment violations, including:

• Headlight, taillight, brake light and other lamp-related issues;
• Brake system problems, including 63 citations for inoperative brakes;
• Flat or overly worn tires;
• Inoperative turn signals;
• Oil leaks; and
• Inoperative windshield wipers

While some equipment-related issues may seem minor, they can contribute to a truck driver losing control of the vehicle, resulting in a serious New Jersey Truck accident.

Proving a Negligence Case Against a New Jersey Trucking Company

In any personal injury case, New Jersey truck accidents included, an accident victim must be able to establish that the defendant was negligent before recovering for their injuries. Proving a truck driver’s negligence may be straightforward, but that is not always the case. In situations involving distracted driving, drunk driving or reckless driving, accident victims may not be able to easily establish a truck driver’s negligence. However, when a truck accident’s causes are unknown, or are related to an equipment malfunction, this opens the door to several defenses. If a truck driver can show that the accident could have been caused by something other than their negligence, they may avoid liability, leaving an accident victim without any means of recovery. Another hurdle can arise if the truck driver does not have sufficient assets or insurance coverage to fully compensate an accident victim.

One way around this is to name all potentially liable parties in your truck accident claim. For example, almost all truck accident victims should consider naming the truck driver’s employer as a defendant in the claim. Under New Jersey’s vicarious liability laws, an employer is responsible for an employee’s negligent acts, as long as the employee was acting within the scope of their employment at the time of the accident. Most truck accidents occur while the truck driver is transporting goods, or on their way to pick up a load, meaning trucking companies are often liable for accident victim’s injuries.

Additionally, when an accident is the result of defective equipment, the manufacturer should be named a defendant. This reduces the chances of not being able to recover based on a defendant’s shifting of blame onto a non-present party. In other words, if all potentially liable parties are included in a lawsuit, even if the truck driver can show that the accident was caused by faulty equipment, an accident victim would be able to recover from the equipment manufacturer.

Common Injuries Sustained in Truck Accidents

Some of the most common injuries individuals face after devastating truck accidents include:

Traumatic Brain Injuries
• Head Trauma
Spinal Cord Injuries
• Paraplegia
• Quadriplegia
Amputations
• Broken Bones
• Internal Injuries
Burns
• Death
