When you are injured in a car crash, many New Jerseyans assume the other vehicle that caused their accident will have the at-fault driver’s insurance carrier pay for their medical bills, etc. However, New Jersey is a “no-fault” state – meaning each driver’s insurance pays for their own medical bills after an accident, regardless of who was at-fault. Therefore, your own car insurance (not the defendant’s car insurance) will be used to pay for your medical bills via the personal injury protection (PIP) insurance coverage you selected. Importantly, your PIP coverage covers you, and any passengers in your car if they don’t have any car insurance coverage of their own. Your car insurance may also cover, depending on your insurance selections, lost income, rental car expenses, etc.
Importantly, property damage to your vehicle is NOT covered by PIP; rather any repairs your vehicle sustains would be covered by your collision insurance coverage.
