I was hit by a Lyft driver who was on the clock when he hit me. Does Lyft’s insurance cover the accident or the driver’s personal insurance?

In 2017, New Jersey passed a new law that regulates many aspects of how Lyft operates its business in the state, including what type and the amount of insurance coverage that is required. Under the new law, both the driver personally, as well as Lyft has to have coverage in case the vehicle is involved in an automobile crash. The new law requires Lyft to maintain coverage of a minimum of $1.5 million. So, even if your Lyft driver does not have insurance or not enough insurance, then the Lyft coverage will kick in. This also applies to accidents that are caused by other drivers.

If you were hit by a Lyft driver, then you could file a lawsuit against both the driver and/or Lyft itself. However, if the Lyft driver does not have a passenger, but is logged into the Lyft system and is looking for passengers, then the insurance coverage is different. Under this scenario, a Lyft driver must maintain the following coverage requirement:

●$100,000 of coverage for bodily injury or death per accident,

●$25,000 of coverage for property damage.
