Does Uber’s insurance cover the accident or does the driver’s personal insurance?
In 2017, New Jersey passed a new law regulating many aspects of how Uber operates its business in the state, including what type and the amount of insurance coverage is required. Under the new law, both the driver and Uber are responsible to have coverage in case the vehicle is involved in a car crash. Despite the law requiring coverage, sometimes Uber drivers let their insurance coverage lapse. That is why the new law requires Uber to maintain coverage of a minimum of $1.5 million. So, even if your Uber driver does not have insurance or not enough insurance, then the Uber coverage will kick in. This also applies to accidents that are caused by other drivers.
If you were hit by an Uber driver, then you could file a lawsuit against both the driver and/or Uber itself. However, if the Uber driver does not have a passenger, but is logged into the Uber system and is looking for passengers, then the insurance coverage is different. Under this scenario, Uber would have the following coverage requirement:
- $50,000 of coverage for bodily injury or death per person,
- $100,000 of coverage for bodily injury or death per accident,
- $25,000 of coverage for property damage.
