According to the New Jersey Workers’ Compensation Act, the definition of a “minor” is anyone under the age of eighteen. It is essential to know that even minors employed illegally are entitled to the same workers’ compensation benefits as any New Jersey worker. Put another way, a worker who is younger than eighteen years old has the same benefits and protections as adult employees.
To be clear, a minor who sustains an injury on the job is eligible for income benefits, permanent disability, temporary disability, and medical benefits. If the minor was injured at work while illegally employed, the employer must pay double the amount of the compensation listed under state law.
Furthermore, if you are the legal guardian or the parent of a minor killed on the job, you may be eligible for workers’ compensation death benefits. New Jersey’s child labor laws limit the number of work hours and the types of jobs they may hold.
Additionally, minors in New Jersey must have an employment certificate for each job. A certification form is obtained from the New Jersey Department of Labor and Workforce Development and Issuing Office of the minor’s school district or the New Jersey Department of Education.
Once the required details are filled out, the employer must agree to and sign a Promise of Employment statement listing the hours of work offered to the child and that they would not be allowed to work more than the law allows.
