Is my injury considered a permanent partial disability?

The New Jersey State Supreme Court has a two-pronged test to determine whether an injured worker is eligible for permanent partial disability benefits. Both of the following criteria must be met for you to receive payments:
 
• There is evidence of impairment of a particular body part or major organ.
• Your work ability has been reduced, or your injury has a substantial impact on non-work activities.
 
A permanent partial disability is defined as an injury that reduces your working ability to some degree. You may be able to return to work but in a reduced capacity due to the injury. For example, workers who have suffered limb loss or been blinded may qualify for permanent partial disability benefits.
 
The level of benefits depends on the extent of the injury and your loss of function. Your loss of function is evaluated based on medical evidence and your testimony. A determination of whether an injury can be considered a permanent partial disability is typically not made until the employee finishes medical treatment and has a final prognosis.
