Important Guidelines for Workers’ Compensation Claims in New Jersey
According to the New Jersey Department of Labor and Workforce Development, the number of reported accidents in 2022 by NJ workers injured on the job was 141,594. To ensure a successful recovery from your workplace injury, New Jersey workers should be mindful to follow several very important guidelines. These include:
- Make sure you keep your appointments with your company authorized treating doctor.
- You must treat with an authorized company doctor – if you decide to see your own personal doctor for your work injury, the workers’ compensation insurance carrier will likely refuse to pay your doctor’s medical bills.
- When you are eventually released by the treating doctor from your company’s workers’ compensation insurance carrier, and are therefore advised you can return to work, you must return to work. Should you decide to not return to work, your company may note this as an “unexcused absence.” You should communicate with your treating doctor should you not feel you can return to work because of your injury.
- You may be required to be examined by a doctor chosen by your employer’s insurance provider to validate your disability claim. These exams are called IME (a.k.a. defense medical exam) examinations. It is important to attend this IME exam appointment, as failure to do so may jeopardize your workers’ compensation claim.
NOTE: if your workers’ compensation insurance carrier denies approval of medical treatment recommended by your authorized treating doctor, you should immediately contact a workers’ compensation attorney. If you are out of work per the recommendation of your authorized treating doctor, you should immediately contact a workers’ compensation attorney. Your lawyer can file a motion with the workers’ compensation court to compel the workers’ compensation insurance carrier to pay for your recommended medical treatment or to pay temporary disability benefits for the time you are out of work.
